These Terms and Conditions ("Terms") govern your access to and use of the MCAT Prime website and applications at edu-learnatopia.base44.app (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Eligibility and Accounts
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when registering and to keep it up to date.
3. User Responsibilities
You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others. You may not: (a) misuse the Service to generate harmful or abusive content; (b) attempt to access data or systems you are not authorized to access; (c) interfere with or disrupt the Service; (d) reverse engineer or scrape the Service; or (e) use the Service to cheat on any actual examination.
4. Subscriptions and Payments
Paid plans are billed on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize us to charge the applicable fees until you cancel. You can cancel anytime from the Subscription page; cancellation takes effect at the end of your current billing period. Fees are non-refundable except where required by law. We may change pricing with reasonable advance notice.
5. Free Trial
We may offer a free trial for a limited period. Trial access is subject to the feature limits described at sign-up. If you do not cancel before the trial ends, your plan may convert to a paid subscription as described at checkout.
6. Intellectual Property
The Service, including its design, software, content, and AI-generated practice questions, is owned by MCAT Prime and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial study purposes. You may not copy, redistribute, or resell Service content without our permission.
7. User Content and Feedback
Any feedback, corrections, or suggestions you submit (such as reported wrong answers) may be used by us to improve the Service without any obligation or compensation to you. You retain ownership of any original content you submit and grant us a license to use it for the purpose of operating and improving the Service.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated answers are always correct. Practice questions are study aids and are not a substitute for official exam content. You should always verify answers independently.
9. Limitation of Liability
To the fullest extent permitted by law, MCAT Prime and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless MCAT Prime and its affiliates from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and without notice. Upon termination, all licenses granted to you end immediately. You may stop using the Service at any time; if you have a paid subscription, you remain responsible for fees accrued before termination.
12. Governing Law
These Terms are governed by the laws of the jurisdiction in which MCAT Prime operates, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction, and you consent to their exclusive jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
